1. Introduction
Co•fé is a brand and mobile application owned and operated by Co-fé GmbH, a company registered in Germany. Throughout this document, "Co•fé", "we", "us", or "our" refer to both the Co•fé application and Co-fé GmbH. These Terms of Service ("Terms") govern your use of Co•fé, including all related content, services, and functionalities.
By downloading, installing, or using Co•fé, you agree to be bound by these Terms. If you do not agree, you must not use the service.
2. Availability
Co•fé is available on iOS (via Apple's App Store) and Android (via Google Play). Your use of the app is also subject to the applicable terms of the platform through which you download it (Apple's Licensed Application End User License Agreement or Google Play's Terms of Service). In case of conflict between these Terms and any platform-specific terms, these Terms shall prevail to the extent permitted.
3. Scope of licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to use Co•fé on any compatible device you own or control, as permitted by the applicable platform's usage rules.
4. User accounts
To access Co•fé's features, you need to create an account. You agree to provide accurate information, keep your login credentials secure, and accept responsibility for all activities under your account. We reserve the right to suspend or terminate accounts suspected of unauthorised activity, abuse, or violations of these Terms.
5. Social features and community guidelines
Co•fé includes social features that allow you to interact with other users. These include checking in at cafés, showing your presence to others, sending pings ("Say Hi"), adding friends, and creating or joining groups.
5.1 Expected behaviour
You agree to use these features respectfully and in good faith. Specifically, you must not:
- Use the "Say Hi" ping feature to harass, spam, or intimidate other users.
- Create fake accounts or impersonate other people.
- Share offensive, discriminatory, threatening, or illegal content through your profile, group descriptions, or any other user-visible field.
- Use groups to organise or promote illegal activities.
- Stalk, follow, or track other users outside the app based on their check-in information.
5.2 Blocking and reporting
You can block any user at any time. Blocked users cannot see your profile, check-in status, or send you pings. You can report users or content that violates these guidelines by contacting support@co-fe.de.
5.3 Moderation
We reserve the right to moderate, restrict, or remove any user-generated content (including profile information, group content, café reviews, and photos) that violates these Terms or applicable laws. We may suspend or terminate accounts that repeatedly violate community guidelines.
6. User-generated content
Co•fé allows users to contribute café listings, upload photos, post reviews, create group content, and maintain profile information. You are responsible for the content you share and agree that:
- Your contributions must be lawful, respectful, accurate to the best of your knowledge, and relevant to the Co•fé community.
- By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute your contributions within the platform. This licence ends when you delete the content or your account, except for content that has been shared with or relied upon by other users (e.g. café listings and reviews, which may be retained in anonymised form).
7. Subscriptions and payments
Co•fé offers optional paid subscription plans to unlock additional features. By purchasing a subscription, you agree to the following:
- Subscription plans: Current plans and pricing are displayed in the app. Features and pricing may change; existing subscribers will be notified in advance of any material changes.
- Billing and auto-renewal: Subscriptions renew automatically at the end of each billing period (monthly) unless cancelled at least 24 hours before the renewal date.
- Payment processing: All payments are processed by the respective app store (Apple App Store or Google Play). We do not process payments directly.
- Managing and cancelling: You can manage or cancel your subscription through your Apple ID or Google Play account settings.
- Refunds: Refunds are subject to the policies of the respective app store.
8. Right of withdrawal (Widerrufsrecht)
If you are a consumer in the European Union, you have the right to withdraw from a subscription purchase within 14 days of the transaction without giving any reason. To exercise this right, contact us at support@co-fe.de or manage the cancellation through your app store account.
Please note that if you begin using the subscription services during the withdrawal period, you may be required to pay for the services already provided up to the point of withdrawal.
For subscriptions purchased through the Apple App Store or Google Play, the withdrawal process is managed by the respective platform in accordance with their policies. The statutory right of withdrawal exists independently of the technical refund process operated by Apple or Google.
9. Intellectual property
Co•fé and all associated branding, logos, content, and software are the exclusive property of Co-fé GmbH. You may not copy, modify, distribute, reverse-engineer, or attempt to extract the source code of the app, or use any trademarks, logos, or copyrighted material without our written permission.
10. Third-party services
Co•fé integrates with third-party services including Google Maps, Apple Maps, authentication services (Apple ID), and payment providers (Apple App Store, Google Play). By using these services through Co•fé, you also agree to their respective terms and policies. We are not responsible for third-party availability, security, or data handling.
11. Disclaimer of warranties
Co•fé is provided on an "as is" and "as available" basis. We do not guarantee that the service will always be available, uninterrupted, or error-free, or that all café information (e.g. policies, amenities, opening hours) is accurate or up to date. Café information is largely community-contributed and may not reflect current conditions.
12. Limitation of liability
To the maximum extent permitted by applicable law, Co-fé GmbH shall not be liable for any indirect, incidental, or consequential damages, or for loss of profits, data, or business interruption arising from your use of Co•fé.
Our total liability for any claims arising from or related to these Terms or your use of Co•fé shall not exceed the amount you have paid to us in the 12 months preceding the claim, or €50.00, whichever is higher.
Nothing in these Terms limits our liability for damages caused by wilful misconduct or gross negligence, for injury to life, body, or health, or for any other liability that cannot be excluded or limited under German law.
13. Maintenance and support
We are responsible for maintaining and supporting Co•fé. Neither Apple nor Google has any obligation to provide maintenance or support services for the app.
14. Termination
We reserve the right to suspend or terminate your access to Co•fé at any time, without notice, if you violate these Terms or misuse the service. You may delete your account at any time through the app's profile settings.
15. Changes to these Terms
We may modify these Terms at any time. Material changes will be communicated through the app. Your continued use of Co•fé after changes means you accept the revised Terms. If you do not agree, you must stop using the service and delete your account.
16. Governing law and dispute resolution
These Terms are governed by the laws of the Federal Republic of Germany. If you are a consumer in the European Union, you additionally benefit from any mandatory provisions of the consumer protection laws of your country of residence.
We are not willing or obligated to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherstreitbeilegung).
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
